Arizona articles · What the court is deciding
A court has been deciding who owns Arizona’s water since the 1970s
Seven in ten of the sections anybody can buy sit inside a general stream adjudication that has not concluded. Whatever it eventually decides will bind the ground.
Arizona has been adjudicating its major watersheds for half a century. The Gila River and Little Colorado River general stream adjudications are cases in which a court will eventually decide, for every claimant in the watershed, what right they hold and where it ranks. They were filed in the 1970s. They are not finished.
Sections inside a general stream adjudication, and how much of the buyable quarter that is. These cases have been running since the 1970s and are not decreed.

Seven in ten of the sections that contain any private land are inside one. That is not a fringe condition affecting remote ground: it is the ordinary situation for Arizona land.
What it means and what it does not
It does not stop anybody drilling, and it is not a restriction that bites today. What it means is that the legal position of surface water, and of groundwater connected to it, is not settled here. A judgment is coming, and it will bind the land rather than the person who owned it when the case was filed.
For somebody buying a house that is background. For anybody buying a stated water right, or planning anything whose economics depend on that right surviving, it is the central question and it has no answer yet.
The trap inside it
A claimant asserts a right by filing a Statement of Claimant. Failing to file has a consequence written into the statute, and it is not a fine.
A person who fails to file a statement of claimant is barred and estopped from subsequently asserting any rights, and shall be held to have forfeited all claims to water rights previously held.
A.R.S. 45-254(F)
Our record can show whether claims have been filed over a section and how many. It cannot show who was served, which is the question that decides whether that provision reaches a particular owner. The Land report says whether a parcel is inside an adjudication. Whether its owner was served is a question for counsel.
This is general information about Arizona law and records. It is not legal advice or a title search. What applies to a particular parcel is settled by the documents filed against it.
